Terms of Service

1. Acceptance of Terms

By accessing or using Queml ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Queml provides an AI-powered phone system platform that enables businesses to automate call handling, routing, and response through configurable call flows. The Service includes the web portal, flow builder, call processing engine, call recording, and related APIs.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes, including unlawful robocalling or telemarketing
  • Transmit malicious code, spam, or harmful content through the Service
  • Attempt to access other tenants' data or bypass security controls
  • Resell or redistribute the Service without written authorization
  • Use the Service in a way that disrupts other users or degrades system performance

5. Your Data

You retain ownership of all data you upload or generate through the Service, including call flows, scripts, recordings, and call logs. We do not claim intellectual property rights over your content. Your data is isolated within your tenant and is not shared with other users.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our reasonable control.

7. Pricing and Payment

Paid plans are billed monthly or annually as selected at signup. Prices may change with 30 days' notice. Failure to pay may result in service suspension. Refunds are handled on a case-by-case basis.

8. Termination

You may cancel your account at any time through the portal. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

9. Limitation of Liability

To the maximum extent permitted by law, Queml shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless Queml from claims arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Modifications

We may modify these terms at any time. Material changes will be communicated via email or portal notification at least 30 days in advance. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration.
